TERMS AND CONDITIONS
LOYALTY PROGRAM FOR PIZZA MOTO PTY LTD
These terms and conditions apply to your participation in and access to the loyalty program (Loyalty Program), our membership services, use of gift vouchers and other promotional / marketing deals which are operated by Pizza Moto Pty Ltd ACN 666 631 563 (referred to in these terms and conditions as we, us or our). These terms and conditions are to be read in conjunction with our website terms of use, which can be found here.
Upon signing up to our Loyalty Program and verifying your account with us, you agree to be bound by the below terms and conditions and agree to any amendments we make to these terms and conditions from time to time.
1. DEFINITIONS
In these terms and conditions:
(a) GST means the goods and services tax.
(b) Inactive Period means a period of 12 months.
2. MEMBERSHIP
(a) You may only become a member of the Loyalty Program by:
(i) signing up at a kiosk located at any of our stores or signing up online via our website here; and
(ii) verifying your account via the verification email we will send to your nominated email address.
(b) Once your account is verified in accordance with clause 2(a), you will be provided a virtual membership card which may be used at any store when placing an order.
(c) You agree and understand:
(i) a Loyalty Program membership cannot be shared between multiple people; and
(ii) there is a strict limit of one user per Loyalty Program membership.
(d) At our sole discretion:
(i) we reserve our rights to decline your membership application to the Loyalty Program;
(ii) we may cancel your membership within the Loyalty Program at any time with there being no refund of any points you may have accrued; and
(iii) we may cancel your membership within the Loyalty Program if you make no purchases under your membership for a period greater than the Inactive Period.

3. POINTS AND REDEMPTION OF POINTS
(a) Purchases made at any of our stores under your Loyalty Program membership can earn you points.
(b) Subject to clause 3(f), points you accumulate at any of our stores under your Loyalty Program membership may be used to redeem gift vouchers which may be used at any of our stores.
(c) You must ensure your virtual Loyalty Program membership card is scanned at a kiosk in our store before you may earn any points from a purchase you make.
(d) You will receive 10 points for every $1 (inclusive of GST) spent at one of our stores under your membership when you scan your virtual membership card before the purchase.
For example:
(i) you attend one of our stores and scan your virtual membership card;
(ii) you proceed to make a $10 purchase after having your virtual membership card scanned at one of our kiosks; and
(iii) you receive 100 points which are credited to your membership account.
(e) Subject to clause 5.3, you may use multiple gift vouchers in the same purchase.
(f) Gift vouchers cannot be used in combination with any promotional offers which we provide.
(g) Points are non-transferrable and cannot be redeemed for any form of currency or cash.
(h) Each point we issue to your Loyalty Program membership account has a 12-month expiry from the date that respective point was issued to you.
(i) All and any gift vouchers you receive or purchase from us will expire 36 months after the date of issue / date of purchase.
(j) We are not obliged to provide you a physical membership card upon signing up to our Loyalty Program.
(k) We are not obliged to transfer any accumulated points across to a new account if you lose access to your Loyalty Program membership account.
(l) For the avoidance of doubt, you are not entitled to receive any points for a purchase at our store which uses a digital gift voucher.
(m) For the avoidance of doubt, a reference to ‘gift voucher’ in these terms and conditions means a gift voucher which:
(i) is properly and validly issued by us; and
(ii) has not expired.
4. YOUR ACCOUNT
(a) It is your sole responsibility:
(i) to ensure your details associated with your Loyalty Program membership are correct at all times; and
(ii) the correct amount of points have been added or deducted from your Loyalty Program account.
(b) Please contact our helpdesk at info@italiamoto.com if you need to change your date of birth or if it was incorrectly inserted at the time you registered for a Loyalty Program membership account.
For the avoidance of doubt, you may only correct / modify your date of birth once.
(c) You may amend the email address for your Loyalty Program membership account at any of our stores during ordinary business hours.
5. MARKETING AND PROMOTIONS
5.1 Marketing
(a) You agree to receive marketing material informing you of any upcoming marketing activities, promotions and / or offers.
(b) Any information you provide us at the time of signing up to our Loyalty Program is subject to our Privacy Policy.
(c) We may use any information collected about you and disclose such information to third parties, including but not limited to agents, contractors, service providers and our marketing partners.
(d) We reserve our rights to use information collected about you for promotional, publicity, marketing and research purposes, including but not limited to utilising email and SMS messaging services.
(e) For the avoidance of doubt, all and any promotional offers, gift vouchers or other deals advertised by us cannot be exchanged or redeemed for cash consideration.
5.2 Complimentary Gift Voucher Promotional Offer
(a) Each occasion you accumulate 2,000 points on your Loyalty Program membership account, you are entitled to receive and claim a $10 (inclusive of GST) digital gift voucher from us to be applied to purchases at any of our stores (Complimentary Voucher).
(b) Once received, the Complimentary Voucher will expire 36 months later from the date of receipt.
(c) The Complimentary Voucher:
(i) will be emailed to you by us as soon as reasonably practicable after you successfully claim a Complimentary Voucher with your points; and
(ii) must be used in a single transaction, and any unused amounts will be forfeited.
5.3 Complimentary Gelato Promotional Offer
(a) Once you sign up to our Loyalty Program and successfully verify your membership, we will provide you a complimentary small-sized, single scoop, one-time only use gelato voucher (Gelato Sign Up Promotional Voucher).
(b) The Gelato Sign Up Promotional Voucher:
(i) must be used within 14 days of receiving the voucher;
(ii) may only be redeemed in a purchase where you spend more than $10.00 in the same transaction; and
(iii) cannot be used in combination with any other digital gift voucher or Loyalty Program promotional offer.
6. GENERAL
6.1 Severability
Any part of these terms and conditions which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity or enforceability of the remainder of these terms and conditions is not affected.
6.2 Survival
Any clause that is intended to survive termination of these terms and conditions will do so.
6.3 Governing law and jurisdiction
(a) These terms and conditions are governed by the laws of the Queensland, Australia.
(b) You submit to the non-exclusive jurisdiction of the courts sitting in Queensland, Australia.
