This privacy policy sets out how we may collect, hold, use, and disclose your personal information. We may update this policy from time to time by publishing the updated policy on our website. We encourage you to check our website regularly to ensure you are aware of our current policy. 

1.    BACKGROUND
Pizza Moto Pty Ltd ACN 666 631 563 and its related entities (referred to in this privacy policy as we, us, or our) recognise your privacy to be very important, and we are committed to protecting the personal information we hold about you in accordance with the Privacy Act, including the APPs.

2.    DEFINITIONS
In this privacy policy:
(a)    APPs means the Australian Privacy Principles set out in Schedule 1 of the Privacy Act;
(b)    Loyalty Program has the meaning given to that term in our Loyalty Program Terms and Conditions which can be found here;
(c)    OAIC means the Office of the Australian Information Commissioner;
(d)    personal information means any information or opinion about an individual who is identified or reasonably identifiable, regardless of whether it is recorded in a material form or not; 
(e)    Privacy Act means the Privacy Act 1988 (Cth); and
(f)    sensitive information is a subset of personal information and includes information or an opinion about an individual's racial or ethnic origin, political opinions, religious or philosophical beliefs or affiliations, membership of a political, professional or trade association or trade union, sexual orientation or practices, criminal record, health or genetic information, biometric templates, and biometric information used for verification or identification.

3.    COLLECTION OF YOUR INFORMATION
(a)    You understand that we may collect and hold certain personal information about you if you:
(i)    enquire about, purchase, or procure our goods or services;
(ii)    visit our website or interact with us online;
(iii)    subscribe to or opt in to receive our publications or marketing communications;
(iv)    register for or attend our events;
(v)    register your interest in, or apply for, a job with us; or
(vi)    otherwise interact or have dealings with us.
(b)    The type of personal information that we collect and hold about you will depend on our relationship with you, and may include:
(i)    name, title, gender, date of birth, contact details (such as your residential address, postal address, telephone number, and email address);
(ii)    dietary and other specific requirements when attending our premises and events or otherwise procuring our goods or services (which could include sensitive information if it relates to your health, disability or religion); 
(iii)    identity information (such as passport, driver's licence, and other government issued identity information), nationality, citizenship or residency status, and confirmation of your eligibility to work in Australia;
(iv)    contact details of your referees;
(v)    the outcome of any police or background checks including any relevant details of criminal convictions, where applicable;
(vi)    employment history, qualifications, and educational background; 
(vii)    billing and financial information (such as credit card details, bank account and superannuation details);
(viii)    any other personal information that you choose to disclose to us during the recruitment process (including an interview), which may include sensitive information; and
(ix)    personal information and sensitive information provided to us in communications (including in person, by email, over the phone, via a web-form and virtually).
(c)    We only collect sensitive information about you where it is reasonably necessary for our functions or activities and either:
(i)    you have consented to the collection (which may, in some cases, be implied from the circumstances); or
(ii)    we are required or authorised to do so by law (including where an exception under the APPs applies).
(d)    We are committed to diversity and inclusion, and as part of this commitment, we may collect sensitive information about your sexual orientation, gender identity, racial background, religious preferences, or whether you identify as Aboriginal or Torres Strait Islander.  We will only collect this information if you choose to provide it to us and we will only use this information to assess the effectiveness of our equal employment opportunities policies and not for any other purpose.

4.    METHOD OF COLLECTION
(a)    We generally collect personal information directly from you, through the use of any of our standard forms including paper or digital forms (such as the form you may use to apply to our Loyalty Program), over the internet, via email, through telephone conversations with you, or via any online surveys you complete which are provided by us or one of our third-party partners.
(b)    Notwithstanding clause 4(a), there may be occasions where your personal information is indirectly collected because it would be unreasonable or impractical to collect personal information directly from you.  This may include from:
(i)    government departments and agencies, regulatory authorities and licensing bodies, courts and tribunals, law enforcement agencies, or credit reporting bodies;
(ii)    search, ratings and recruitment agencies, or former employers and referees who you refer us;
(iii)    your emergency contact, or a third party acting on your behalf (such as your legal representative, or attorney); and
(iv)    publicly available sources (such as public registers, online searches, social media platforms and searches made under the Freedom of Information Act 1982 (Cth)).
(c)    If you provide personal information about another person to us, we ask you to refer that person to our privacy policy. You must also only provide sensitive information about another person to us where you have that person's consent to do so, or the disclosure is otherwise permitted under the Privacy Act.
(d)    If we receive unsolicited personal information, we will assess whether it is necessary for our purposes. If it is not needed, we will securely destroy or de-identify it as soon as practicable, unless required to retain it for legal reasons. If the unsolicited personal information is necessary, we will store it securely and handle it in accordance with this privacy policy. We will not disclose unsolicited personal information to third parties unless required by law.

5.    PURPOSE OF COLLECTION
We may collect, hold, use, or disclose your personal information for the purpose for which it was collected, and other purposes.  These purposes may include but are not limited to:
(a)    providing you with our goods or services;
(b)    providing you access to our Loyalty Program;
(c)    allowing you to place orders through our website or our app, as applicable;
(d)    providing you with perks or rewards offered via our Loyalty Program;
(e)    providing you with and notifying you of promotional material, special offers, and upcoming deals that may be available to you;
(f)    facilitating our business operations, including:
(i)    establishing, maintaining, and managing our relationship with you and communicating with you in the ordinary course of that relationship; 
(ii)    identity verification, employment acceptance and conflict processes, credit checks, accounting, insurance, reporting, record keeping, and audits; and
(iii)    complying with our obligations including in respect of WH&S, training, and superannuation;
(g)    seeking your feedback about our services including through participation in market surveys;
(h)    analysing and improving our business, goods, and services;
(i)    ensuring the safety and security of our people, workplaces, and systems; 
(j)    complying with or enforcing legal requirements, industry best practice, and taking appropriate action (including complying with court orders, establishing, exercising and defending our legal rights and interests, and responding to compliance audits); and
(k)    communicating with you in connection with your enquiries, requests, or feedback, or after you place an order for or receive goods or services from us, including but not limited to:
(i)    for the purpose of receiving feedback regarding the goods or services you received from us, our staff, and operating our website; and
(ii)    to obtain testimonials from you.
If you no longer wish to receive our marketing communications, you may unsubscribe or opt out at any time by using the unsubscribe link contained in our marketing communications or contacting our Privacy Officer using the details in the Contact Us section.
If you apply for a role with us but are unsuccessful, we may also retain and use your personal information to assess your suitability for other roles within our organisation.

6.    FAILURE TO PROVIDE PROPER INFORMATION
You understand that when we interact with or have dealings with you, we will usually need to collect some of your personal information. If the personal information you provide to us is incomplete or inaccurate, we may be unable to provide you with the goods, services or information you are seeking.  In some circumstances you may be able to choose whether to provide your personal information or use a pseudonym.

7.    DISCLOSURE
If we do provide your information to any third party, we will take reasonable steps to ensure those parties protect your information in the same way we do. 
Third parties to whom we may disclose your personal information for the purposes outlined above may include:
(a)    our agents, contractors and external advisers who carry on our functions and activities or who assist us to carry on our functions and activities from time to time; 
(b)    service providers who are contracted by us to perform certain services, including to assist us in operating our business (including credit reporting bodies, technology and marketing service providers, search and recruitment agencies, event service providers, accounting, audit and professional advisors, banks, insurers and payment processing providers); 
(c)    our legal advisors, when needed; 
(d)    government departments and agencies, regulatory authorities, licensing bodies, courts and tribunals, law enforcement agencies or any other person as required or authorised by law (including the Privacy Act);
(e)    any third parties that you have authorised us to disclose your personal information to;
(f)    our related entities for our internal business operations; and
(g)    our related entities and other organisations with whom we have affiliations so that those organisations may provide you with information about goods or services that we believe may be of interest to you.

8.    OVERSEAS DISCLOSURE
From time to time, we may disclose your personal information to goods or service providers (including but not limited to technology service providers) who store data in overseas locations, such as the US. In these cases, we take measures to ensure that any overseas recipient complies with the APPs in handling the personal information we share with them.

9.    SECURITY AND DATA QUALITY
We may hold personal information electronically and in hard copy form, both at our premises and with the assistance of our service providers.  We take reasonable steps to protect your personal information that we hold from misuse, interference and loss, and from unauthorised access, modification or disclosure, including implementing and maintaining physical and electronic security measures including but not limited to restricting physical access to our offices, firewalls, and secure databases. 
We take reasonable steps to ensure that the personal information that we collect, hold, use, and disclose about you is accurate, complete, and up-to-date and, in relation to the purpose of our use or disclosure, relevant. Personal information is securely destroyed or de-identified when no longer needed for the purpose it was collected, or where we are no longer required by law to retain it (whichever is the later).

10.    INTERNET USERS
10.1    Domain name and IP address
We may collect additional personal information relating to you when accessing our website, including information relating to your IP address and domain name.
10.2    Cookies
(a)    Our website uses “cookies” and similar technologies to enhance your browsing experience, ensuring that the website is tailored to your preferences and is streamlined, and allows us to better identify users when they access our content.
(b)    While our cookies do not identify you personally, they may link back to our third-party provider’s database records about you and your particular usage of our website.
(c)    The cookies we use serve various purposes, including but not limited to:
(i)    monitoring the usage of our website;
(ii)    tracking what pages are viewed by you and other users; and 
(iii)    analysing what selections are made on our website including when procuring our goods or services, such as when ordering food, drinks or merchandise.
(d)    Our third party payment facilities providers may use cookies when you pay and place an order online via our website for identification and anti-fraud purposes.
(e)    We also use cookies to assist with our online marketing and to advertise our goods and services to visitors on other platforms, such as Google Ads, Facebook, X (formerly Twitter), Instagram, and others. The cookies placed by these third party platforms help us assess the success of our business partnerships, enhance website performance, and personalise your experience on both our website and those of our service providers. Accordingly, if you visit other websites or platforms, you may come across advertisements for our goods or services based on your prior visits. Further, we may share the data gathered through cookies with third parties to support our marketing efforts.
(f)    By using our website and not opting out of cookies, you agree to our use of cookies as outlined in this privacy policy.
(g)    Most web browsers are configured to accept cookies automatically. However, you may change your browser settings to either prompt or refuse cookies entirely (including cookies used by us), although, this may cause certain functions or features of our website to become unavailable or less effective.
10.3    Google Analytics 
(a)    Our website uses the service known as ‘Google Analytics’ which is provided by Google, Inc.
(b)    Google Analytics utilises cookies and information generated by their cookie about you (including the IP address you use) whilst visiting our website may be transmitted to and stored by Google on their own servers (which may or may not be located in Australia).
(c)    Google Analytics will generally use information obtained from their cookies about you to evaluate your use of our website, prepare reports on website activity and provide other services to us relating to website activity and internet usage. These cookies can be disabled; however, this may cause certain functions of our website to become unavailable.
(d)    Google Analytics may provide information described under this clause 10.3 to third parties when they are required to do so by law, or where those same third parties process information provided by Google.
(e)    By entering and using our website, you consent to the handling of data about you by Google in the manner described throughout this privacy policy.
10.4    Security
As our website is linked to the internet, and the internet is inherently insecure, we cannot provide any assurance regarding the security of transmission of information you communicate to us online.  We also cannot guarantee that the information you supply will not be intercepted while being transmitted over the internet.  Accordingly, any personal information or other information which you transmit to us online is transmitted at your own risk.

Our website may contain links to other websites operated by third parties.  We make no representations or warranties in relation to the privacy practices of any third party website and we are not responsible for the privacy policies or the content of any third party website.  Third party websites are responsible for informing you about their own privacy practices.

11.    ACCESS AND CORRECTION
(a)    You may request access to personal information we hold about you by making a written request to our Privacy Officer, using the details in the Contact Us section below. We will respond to your request within a reasonable period. We may charge a reasonable fee for processing your request (but not for making the request).
(b)    If you believe the personal information we hold is inaccurate, incomplete, or out of date, please notify us. We will take reasonable steps to correct the information.
(c)    In some circumstances, we may decline your request to access or correct your personal information. If we do so, we will provide you with a written notice explaining the reasons for our refusal, unless it would be unreasonable to do so.

12.    RETENTION STATEMENT
We determine how long to retain different types of personal information based on what is necessary for our business operations, taking into account our legal obligations and statutory retention periods. We will retain and delete your personal information in accordance with our policies and procedures, and applicable laws.

13.    COMPLAINTS 
(a)    If you have concerns about a breach of the Privacy Act or how we have handled your personal information, please contact our Privacy Officer using the details in the Contact Us section below. We will take reasonable steps to investigate your complaint and respond within a reasonable timeframe.
(b)    If you are not satisfied with our response, you can lodge a complaint with the OAIC at www.oaic.gov.au, via email at enquiries@oaic.gov.au, or by calling 1300 363 992.
